"It is the commonwealth's position that this defendant is a danger to the children of the commonwealth and that the only way the children can be protected from him is if he is incapacitated." in other words, the sentence is appropriate given facts not in evidence, accusations he was not tried for.

Prosecutors said more than 2,800 people online had viewed the photographs, which included images of sexual assaults on children ranging from toddlers to 13 year olds. "I don't know that I think that 10 years in prison is the appropriate best thing for this defendant," Lynch said after the verdict. "On the other hand, it's what Congress has ordained." Some judges are progressive thinkers and not afraid to take what might be unpopular stands. It is just too bad that it did this young man no good.
